1. INTRODUCTION & ACCEPTANCE OF TERMS
These Terms of Service (“Terms”) govern access to and use of all websites, online platforms, portals, programs, services, materials, and content operated by iThrive Incorporated, doing business as iThrive Youth Development Institute (“iThrive,” “we,” “us,” or “our”).
By accessing or using iThrive services in any manner, including but not limited to visiting our website, creating or using an account, enrolling in programs, submitting work, or engaging with content, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you may not access or use iThrive services.
2. ELIGIBILITY, DEFINITIONS & AUTHORIZATION
2.1 Eligibility
iThrive services are available to:

Individuals who are eighteen (18) years of age or older; and

Minors who participate in iThrive programs with proper authorization from an Authorized Adult.
Minors may not independently enter into a legally binding agreement.
2.2 Definitions
For purposes of these Terms:

“Participant” means the individual enrolled in and engaging in iThrive programs, including minors and adults, who actively participate in educational, developmental, coaching, or enrichment activities and submit work or responses.

“Authorized Adult” means a parent, legal guardian, foster caregiver, court-appointed caregiver, case manager, sponsoring organization, or other individual or entity legally authorized to consent to a Participant’s involvement in iThrive programs.

“Account” means login credentials or access permissions used to access iThrive platforms or portals. Accounts are provided for access purposes only and do not determine legal identity, intellectual ownership, or authorship.
2.3 Authorization for Minor Participants
When a Participant is under the age of eighteen (18), an Authorized Adult must:

Provide informed consent for enrollment and participation;
-
Execute all required agreements, waivers, and consent forms;
-
Authorize access to iThrive platforms, portals, and services.
The Authorized Adult’s role is limited to legal authorization and administrative consent.
Participants engage independently in learning, developmental, and intellectual activities appropriate to their age and developmental level.
3. NATURE AND SCOPE OF SERVICES
iThrive provides educational, enrichment, leadership development, life-skills, coaching, and youth development programming.
iThrive does not provide:

Medical services
-
Mental health treatment
-
Therapy or counseling
-
Diagnosis or clinical intervention
All services are non-clinical and educational in nature. Nothing provided by iThrive constitutes medical, psychological, or legal advice. Participants requiring such services must seek support from licensed professionals.
4. PROGRAM PARTICIPATION & RELATED AGREEMENTS
Participation in iThrive programs may require execution of additional agreements, including but not limited to:

Member or Participant Agreement
-
Liability Waiver
-
Media Release
-
Emergency & Medical Consent
-
Financial Agreement
These Terms govern general access to and use of iThrive platforms and services and do not replace program-specific agreements. In the event of a conflict, the program-specific agreement controls.
5. ONLINE PORTALS, ACCOUNTS & DIGITAL ACCESS
5.1 Account Access
iThrive may provide access to online portals, learning platforms, or digital tools to support program participation.
Due to platform limitations, access may require an email address. Login credentials may be associated with:

A Participant; or
-
An Authorized Adult, sponsoring organization, or designated administrator.
The use of an email address or account credential is a technical access mechanism only and does not assign intellectual responsibility, authorship, or learning accountability.
5.2 Participant Engagement & Intellectual Work
Participants are the individuals who:
-
Complete activities and assignments;
-
Submit reflections, responses, or creative work;
-
Engage in learning, coaching, and developmental experiences.
All submitted work reflects the Participant’s own engagement and intellectual effort, subject to program guidelines.
Authorized Adults do not direct, complete, or control Participant intellectual work unless required by law or specific program design.
5.3 Access Responsibility
iThrive is not responsible for:
-
Shared or misused login credentials;
-
Unauthorized access resulting from credential loss or misuse;
-
Limitations imposed by third-party platform authentication systems.
6. ACCEPTABLE USE
Users agree not to:
-
Violate applicable laws or regulations;
-
Misrepresent identity or authority;
-
Interfere with platform functionality;
-
Infringe intellectual property rights;
-
Harass, exploit, or harm others.
iThrive reserves the right to restrict, suspend, or terminate access for violations of these Terms or program standards.
7. INTELLECTUAL PROPERTY RIGHTS
All curriculum, program designs, methodologies, materials, branding, logos, content, and training resources are the exclusive property of iThrive Incorporated and are protected by applicable intellectual property laws.
Participants retain ownership of their original submissions. By participating, Authorized Adults grant iThrive a limited, non-exclusive right to use Participant work for educational, evaluative, operational, or program-improvement purposes. Public or promotional use requires a valid Media Release.
Unauthorized reproduction, distribution, or commercial use of iThrive materials is prohibited.
8. FEES, PAYMENTS & REFUNDS
Fees and payment terms are governed by applicable financial agreements or published policies. Unless otherwise stated:

Fees are non-transferable;
-
Refunds are not guaranteed;
-
Missed participation does not entitle a Participant to a refund.
9. THIRD-PARTY SERVICES
iThrive uses third-party platforms for hosting, communication, forms, payments, and digital access. iThrive is not responsible for the independent practices, policies, or performance of such platforms.
10. DISCLAIMER OF WARRANTIES
All services are provided “as is” and “as available.” iThrive makes no guarantees regarding outcomes, results, or uninterrupted access to services.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, iThrive Incorporated shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in or use of services.
12. INDEMNIFICATION
Authorized Adults and adult Participants agree to indemnify and hold harmless iThrive Incorporated from claims, damages, or liabilities arising from:

Violation of these Terms;
-
Misuse of services;
-
Actions of Participants under their authorization.
13. TERMINATION OF ACCESS
iThrive may suspend or terminate access to services for violations of these Terms, program policies, or conduct inconsistent with organizational standards.
14. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of the State of Texas. Any legal action shall be brought in courts located within Texas.
15. CHANGES TO TERMS
iThrive may update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
